Administrative Review Tribunal (ART) — formerly the AAT
If a visa application is refused or cancelled, some decisions may be reviewed by the Administrative Review Tribunal (ART) — formerly the AAT. The Tribunal conducts a merits review, meaning it independently reassesses the case based on the facts and the law, not just the original departmental decision.
Review applications typically must be lodged within 7–28 days of the refusal decision. Missing this window can permanently close review options.
The right to apply for ART review depends on the visa subclass and circumstances. We assess this immediately on your behalf.
The ART can affirm the original decision, vary it, or set it aside and substitute a new decision — including granting the visa.
Where ART review is exhausted or not available, judicial review by the Federal Circuit and Family Court of Australia may be a further option.
